In these terms, Tuinmeubel Care is also referred to as 'we', 'us' or 'our'.
2. Applicability
These Terms of Service apply to every offer made by Tuinmeubel Care and to every order and agreement concluded through our online shop.
Before completing an order, the customer is given the opportunity to review these terms. By placing an order, the customer agrees that these terms apply.
If a provision of these terms conflicts with mandatory consumer law, the statutory rules apply. The remaining provisions continue to apply.
3. Offers and product information
We do our best to present our products, prices, images, volumes, applications, properties and instructions for use as clearly and accurately as possible.
Images are for illustration purposes. Colours, packaging, labels and versions may differ slightly from the actual product, for example if a manufacturer changes the packaging.
Obvious errors, mistakes or typing errors in prices, product descriptions or offers are not binding on us. If we discover an obvious error after an order has been placed, we will contact the customer as soon as possible.
An offer remains valid while it is displayed in the online shop and while stocks last, unless expressly stated otherwise.
4. Formation of the agreement
An order is placed by adding the desired products to the shopping cart, entering the requested details and completing the order using the order button indicating an obligation to pay.
After placing an order, the customer receives an electronic order confirmation. The agreement is formed once we have confirmed the order, unless there is an obvious pricing error, technical malfunction, indication of fraud or another valid reason why we cannot fulfil the order.
We may refuse an order or request additional information where reasonably necessary for fraud prevention, payment checks, product safety or correct delivery.
5. Prices
All consumer prices are displayed in euros and include VAT, unless expressly stated otherwise.
Any shipping costs and other additional charges are clearly displayed before the order is finally placed.
We may change prices and offers. A price change does not affect an order that we have already confirmed, except in the case of an obvious error.
6. Payment
The available payment methods are displayed at checkout.
The customer is responsible for providing accurate and complete payment and billing details. An order can only be processed after payment has been received or approved by the payment provider.
If a payment fails, is reversed or is disputed without justification, we may suspend delivery and charge reasonable collection costs to the extent permitted by law.
7. Delivery
Orders are delivered to the address entered at checkout.
The expected delivery time is usually 3 to 5 business days, counted from the next business day after we have received the order and payment.
Business days are Monday to Friday, excluding official public holidays.
The stated delivery time is indicative, unless a fixed delivery date has been expressly agreed. Delivery may take longer during busy periods, public holidays, promotions, extreme weather or carrier delays.
If a product proves unavailable or cannot be delivered on time, we inform the customer as soon as possible. The customer's statutory rights in the event of late delivery remain fully applicable.
8. Delivery address and delivery risk
The customer is responsible for entering a correct and complete delivery address.
If the customer discovers an address error after ordering, they must inform us as soon as possible. We can only change an address while the order has not yet been processed or shipped.
Any additional costs resulting from an incorrect or incomplete address may be charged to the customer.
For a consumer order, the risk of loss or damage passes to the customer once the order has been received by the customer or a third party designated by them.
9. Cooling-off period and right of withdrawal
In principle, a consumer making an online purchase has the right to withdraw from the agreement within 14 days without giving a reason.
The cooling-off period starts on the day after the consumer, or a previously designated third party other than the carrier, receives the product.
If an order is delivered in several parts, the cooling-off period starts on the day after the last product or part is received.
The consumer may withdraw from the purchase using:
-
the withdrawal function in our online shop;
-
the European model withdrawal form;
-
an email to info@tuinmeubelonderhoud.nl;
-
another clear statement indicating that the consumer wishes to withdraw from the agreement.
When notifying us of withdrawal, please preferably include the name, order number, order date and relevant product.
After notifying us of withdrawal, the consumer has a further 14 days to return the product.
10. Additional 30-day return right
In addition to the statutory cooling-off period, we offer consumers an additional return right of up to 30 days after receipt, unless expressly stated otherwise for the product.
The following conditions apply to return requests made after the statutory 14-day cooling-off period:
-
the product is unused;
-
the product is undamaged;
-
the product is complete;
-
the product is, as far as reasonably possible, in its original packaging;
-
safety seals and closures have not been broken;
-
proof of purchase can be provided.
The additional return right is a voluntary service and does not restrict statutory rights during the first 14 days.
11. Return shipping costs
The direct costs of returning an order are borne by the customer, unless:
-
we delivered the wrong product;
-
the product was received damaged or defective;
-
we stated in writing in advance that we would pay the return shipping costs;
-
the law requires us to bear those costs.
Returns must be adequately packaged. The customer remains responsible for the return shipment until we have received it.
Before returning an item, please contact us at info@tuinmeubelonderhoud.nl. We will then send the return instructions and the correct return address.
12. Refunds following withdrawal
Following a valid withdrawal, we refund the amount due within 14 days at the latest.
We may withhold the refund until we have received the product or the customer has provided evidence that it has been returned, whichever occurs first.
If the entire order is withdrawn, we also refund the original standard delivery costs. Additional costs for a more expensive delivery method chosen by the customer do not have to be refunded.
Refunds are made using the same payment method used for the original order, unless expressly agreed otherwise.
13. Reduction in value
During the statutory withdrawal period, a consumer may only inspect and assess a product as would reasonably be possible in a physical shop.
The consumer is liable for any reduction in value resulting from handling the product beyond what is necessary to establish its nature, characteristics and functioning.
For care products, a reduction in value may occur if a bottle, packaging, safety seal or dispensing closure has been opened, or if some of the product has been used.
We assess any reduction in value carefully on a case-by-case basis. The consumer's statutory rights continue to apply.
14. Exceptions to the right of withdrawal
The right of withdrawal does not apply where a statutory exception applies and we have clearly stated this before purchase.
For example, this may apply to:
-
products made to the customer's specifications;
-
clearly personalised products;
-
products that deteriorate quickly or have a limited shelf life;
-
sealed products that are unsuitable for return for reasons of health protection or hygiene once their seal has been broken.
An exclusion is not applied more broadly than permitted by law.
15. Use of care products
Before use, the customer must always read and follow the label, product description, safety information and supplied instructions for use.
Care products must only be used:
-
on the material and for the application for which the product is intended;
-
in accordance with the recommended dosage and method;
-
with adequate ventilation;
-
with the recommended personal protective equipment;
-
out of reach of children and pets;
-
taking account of the warnings on the packaging.
Always test a product on a small, inconspicuous area first. Materials, coatings, wood species, paint finishes, soiling, age and previous treatments may react differently.
Do not use different products at the same time or mix them, unless the manufacturer expressly states that this is safe and suitable.
16. Advice and expected results
Our selection guides, blogs, step-by-step guides and personal advice are prepared with care and are intended as general guidance when choosing and using products.
The final result also depends on the material, the condition of the garden furniture, previous treatments, weather exposure, the application method and compliance with the instructions for use.
We therefore cannot guarantee an exact colour result or full restoration where this reasonably depends on circumstances beyond our control.
Advice never replaces the manufacturer's safety information, warnings or official instructions for use.
17. Statutory guarantee and conformity
A consumer is entitled to a product that conforms to the contract and always benefits from the statutory guarantee.
If, under normal use, a product does not do what a consumer may reasonably expect, we seek an appropriate statutory remedy. Depending on the situation, this may involve replacement, repair, delivery of missing items, a price reduction or a refund.
An additional manufacturer's or seller's guarantee does not limit the consumer's statutory rights.
Problems caused by misuse, failure to follow the instructions for use, normal wear, incorrect storage, frost, mixing with other products or application to an unsuitable material do not constitute a defect in the product supplied.
18. Damage or incorrect delivery
Check the order as soon as possible after receipt.
Is a parcel visibly damaged, is something missing or has the wrong product been delivered? Contact us as soon as possible, preferably within 48 hours of receipt.
Include the order number and clear photos of:
-
the product received;
-
the damage;
-
the inside and outside of the packaging;
-
the shipping label.
Reporting after 48 hours does not automatically mean that statutory rights expire. Prompt reporting does, however, help us investigate the damage with the carrier.
Keep the packaging until we have assessed the report.
19. Complaints
A complaint can be submitted via:
Email: info@tuinmeubelonderhoud.nl
Telephone: 035 695 2934
When submitting a complaint, preferably include the order number, a clear description and any relevant photos.
We acknowledge receipt of the complaint and aim to provide a substantive response within a reasonable period.
If a complaint cannot be resolved by mutual agreement, the consumer may use the applicable statutory dispute resolution or court procedures.
20. Liability
We are liable for damage insofar as it is the direct result of a breach attributable to us.
We are not liable for damage caused by:
-
incorrect or improper use;
-
failure to follow safety or operating instructions;
-
use on an unsuitable surface or type of material;
-
mixing or combining products;
-
application in unsuitable weather conditions;
-
incorrect storage;
-
incorrect or incomplete information supplied by the customer.
Nothing in these terms limits liability that cannot be excluded by law, including liability for intent or deliberate recklessness and applicable product liability.
21. Force majeure
We are not liable for delays or inability to perform a contract due to circumstances over which we reasonably have no control.
Force majeure includes extreme weather, fire, flooding, strikes, war, pandemics, government measures, transport problems, carrier disruptions, internet or payment system outages and unexpected problems at suppliers.
In the event of force majeure, we contact you as soon as possible and seek a reasonable solution where possible. Statutory consumer rights continue to apply.
22. Website and accounts
The customer is responsible for keeping their customer account login details confidential.
Our webshop must not be used for fraud, abuse, distribution of malicious software, unauthorised system access or other unlawful activities.
We may temporarily suspend or terminate an account where there is reasonable suspicion of fraud, abuse or a serious breach of these terms.
23. Intellectual property
All text, photos, product descriptions, step-by-step guides, selection guides, videos, logos, designs and other webshop content are protected by intellectual property rights.
Content may not be commercially copied, distributed, adapted or republished without prior written permission.
Normal personal use of the webshop and sharing links to our pages are permitted.
24. Personal data
We process personal data when you use our webshop and when we process orders.
Our privacy policy explains which personal data we collect, the purposes for which we use it, the parties with whom we share it and the privacy rights customers have.
25. Changes to the terms
We may amend these terms of service where necessary due to changes in business activities, services, systems or legislation and regulations.
The terms available at the time of ordering will generally continue to apply to that order.
The most recent version is published on our webshop.
26. Applicable law
Contracts with Tuinmeubel Care are governed by Dutch law.
This choice of law does not deprive a consumer of the protection of mandatory consumer law in their country of habitual residence.
Disputes are submitted to the competent court, unless the parties jointly agree on another solution permitted by law.
